There are several important issues that arise when an accident occurs resulting in injury. Some of the most common issues are discussed below.



Statute of Limitations
The Statute of Limitations is the time frame set by the Georgia legislature to bring a claim. Generally, in Georgia, a person has two years from the date of injury to settle his claim or file suit in a personal injury case. There are exceptions to this rule. There are also notice requirements to the at fault party in some instances. An experienced lawyer can help you to determine the time frame applicable to your case and whether formal notice needs to be sent to the at fault party.



Recorded Statements
Many times an insurer will want to take a recorded statement regarding how an accident occurred. If the insurance company requesting the statement is the insurer for the at-fault party, we never advise giving a recorded statement. A person that is not represented by an attorney will not know what pitfalls to watch out for. Insurance adjusters are trained to get an injured person to downplay their injuries, admit fault when they shouldn't and to omit important details that should be included in the statement.

If the insurance company requesting a recorded statement is the insurance company for the injured person, then we advise our clients that they are under a duty to cooperate with their own insurance company. However, we also advise that an attorney needs to be present during the statement to insure that the client does not say anything harmful or omit anything helpful.



Medical Treatment
One of the insurance industries favorite tactics to downplay a client's injuries or devalue their claim is to point out that the injured person had either a delay in getting medical treatment or a gap in getting treatment. We understand that most people do not want to see a doctor on a regular basis. However, it is important to get treated for your injuries so that the doctor can document your medical condition. Many people have come to us after many months have passed seeking help because the insurance company has offered a low amount to settle their claims. Before hiring our firm, they have not received continuous medical treatment and have innocently hurt their cases by doing so. This is another reason why it is so important to have the advice of experienced legal counsel from the start of the case.
